These terms are an agreement between Figmark Solutions, LLC (“Figmark”), and the independent educational consultant or practice that buys a license (“you”). By activating your license, you agree to these terms and to the EssayBrainstormPro Student Data Terms.
What you get. Access to EssayBrainstormPro for your practice: your own counselor login and dashboard, a link generator, code-locked student access, and a library of your students' submissions. Submissions go only to you.
Term and price. One year, at $349 per year, paid in advance. The license must be renewed before the renewal date for continued use. Figmark will give at least [30] days' notice of any price change.
Refunds. No refunds after activation.
Who can use it. You and the staff you authorize, for students you are actively counseling who are 13 or older. Students under 18 need a parent's agreement before you invite them. One license covers one practice; it can't be shared, resold, or sublicensed.
Student data. You control your students' data; Figmark only hosts it for you. You must follow the Student Data Terms, give them to your students and families, and use student work only to help those students. Figmark never sells student data, uses it for advertising, or runs it through AI.
What you can't do. Copy, resell, rebrand, or reverse-engineer the app; use it for anyone other than your own counseling students; or try to reach another practice's data.
Ownership. Figmark owns the app, its design, and its brainstorm questions. Students own what they write. You own your own branding and practice materials.
Support and availability. Figmark provides support by email at info@figmark.io and responds within [2 business days]. The app runs on the hosting platform, and Figmark does not guarantee uninterrupted service.
Ending the license. You can cancel at any time; access continues until the paid year ends. Figmark may suspend or end a license that breaks these terms. When a license ends, you have [30] days to export your students' submissions, after which they are deleted.
Limits. The app is provided “as is.” Figmark is not responsible for admission outcomes or essay quality. Figmark's total liability is limited to the fees you paid in the previous 12 months.
Changes. Figmark may update these terms with at least [30] days' notice. Changes take effect at your next renewal unless the law requires sooner.
